Can you effectively defend a discrimination claim?
The case of Fahmy v Arts Council England shows that an employer must have evidence that they have taken reasonable steps to prevent discrimination in the workplace to be able to defend a claim.
Reasonable steps include having an up to date Dignity at Work policy which has been provided to and read by employees, regular equality training, setting standards of behaviour and ensuring management take care when expressing personal opinions on areas of debate.

Effective Medical Reports
One of the most difficult matters a company, an HR manager, general manager or supervisor has to deal with is employee absence. Part of that process may be obtaining medical reports from a doctor or occupational health adviser. To assist in the absence management process, an effective medical report request should be used in conjunction with robust absence management policies and return to work interviews.
You should have in place an absence management policy and return to work documents, and review the detail provided in your policies and the questions in the return-to-work document at the earliest opportunity.
The request for a medical report may be due to concerns over long term absence, frequent short term attendance issues or an employee may be placed on restricted duties’, and you wish them to return to normal working practices as soon as possible.
The content of the request and the detail in the report may play a significant part if there are claims for unfair dismissal or disability discrimination.
